Florida Divorce, Alimony & Property Division Rules
Florida generally requires at least one spouse to have resided in the state for six months before filing a petition for dissolution of marriage. Because Florida is a no-fault divorce state, the petition generally alleges that the marriage is irretrievably broken rather than assigning legal blame for its end.
Florida Statutes section 61.075 governs property division. The equitable distribution process requires identifying assets and liabilities, determining whether they’re marital or nonmarital, and reviewing financial records before settlement or a court decision.
As of 2026, Florida recognizes temporary, bridge-the-gap, rehabilitative, and durational alimony. Permanent alimony isn’t recognized. Bridge-the-gap alimony addresses short-term transitional needs, is limited to two years, and can’t be modified in amount or duration after it’s ordered.
Durational alimony depends in part on the length of the marriage, the recipient’s reasonable need, and the parties’ net incomes. We review income, expenses, the length of the marriage, and other relevant information before discussing how Florida’s alimony rules may apply.
What to Expect During Your Family Law Case
Representation begins with a detailed consultation about your family dynamics, finances, and priorities. We identify the immediate legal questions, explain the relevant stages, and discuss settlement and litigation options. We also address how Broward County family courts typically handle similar matters without predicting how a judge may decide a particular dispute.
Filing begins the court case and identifies the issues the court will be asked to decide. During discovery, the parties exchange relevant financial, personal, and other case information. This information may be important to requests involving support, parenting plans, or property division.
Mediation is a structured negotiation process that may allow the parties to resolve some or all disputed issues before trial. If they don’t reach an agreement, unresolved matters can be presented to the court. Throughout the case, we provide regular updates about filings, hearing schedules, and information needed for preparation.
Broward County Unified Family Court
Pompano Beach family law cases are handled through the Unified Family Court of Florida’s 17th Judicial Circuit in Broward County. The Unified Family Court model allows one judge to oversee all matters involving one family, including divorce, support, and parenting proceedings.
Family Court Services within the 17th Judicial Circuit provides court-connected resources for eligible cases. These services are separate from our legal representation and may include social investigations, parenting coordination, and referrals for anger management, parenting classes, or supervised visitation. Social investigations through Family Court Services are generally paid for by the parties under Florida Statutes section 61.20, though no cost is charged to a parent who qualifies as indigent.
The Broward County Clerk’s Family Division accepts filings involving:
- Dissolution of marriage and annulments
- Paternity and child support
- Adoptions and termination of parental rights
- Name changes and emancipations
The availability of a court-connected service depends on the type of proceeding and the circumstances before the court. We can explain which filings and procedures are relevant to your case.
